La literatura sobre razonamiento probatorio busca incidir en la determinación de los hechos en los procesos judiciales. Para alcanzar dicho propósito, no basta con dirigir la mirada hacia disciplinas extrajurídicas exitosas e integrar lo que de ellas pueda extraerse a las teorías jurídicas de la prueba y a la práctica judicial. Es necesario, además, considerar el tipo de hechos a probar, los roles de las reglas jurídicas aplicables, y asumir que litigantes y jueces, actuando en un contexto institucional, podrán ser (...) más o menos agudos en la discusión fáctica, entre otras cosas. Minimizar la influencia de tales factores expone a los estudios probatorios a tener un bajo rendimiento práctico. Algo de esto ha ocurrido con la llamada concepción racionalista de la prueba. Su innegable aporte al debate académico en español no ha ido a la par de su impacto judicial. Para explicar esta brecha entre teoría y práctica, identificamos tres creencias-obstáculo que afectan a su discurso sobre la prueba y que deben ser sorteadas si lo que se busca es influir en la forma en que se juzgan los hechos en un sistema judicial realmente existente. In this article Roland Sintos Coloma argues for the relevance of empire as an analytical category in educational research. He points out the silence in mainstream studies of education on the subject of empire, the various interpretive approaches to deploying empire as an analytic, and the importance of indigeneity in research on empire and education. Coloma examines three award-winning books, Lawrence Cremin's The Transformation of the School: Progressivism in American Education, 1876–1957, John Willinsky's Learning to Divide the World: (...) Education at Empire's End, and David Wallace Adams's Education for Extinction: American Indians and the Boarding School Experience, 1875–1928, in order to delineate the heuristic spectrum of the use of empire in educational research. These texts are put in conversation with the interdisciplinary fields of American, postcolonial, race/ethnic, and indigenous studies where questions of empire have received considerable attention. Ultimately, mobilizing empire as an analytical category will enable researchers, policymakers, and educators to establish new connections and dispute long-standing views about discursive, structural, and affective dynamics at local, national, and global levels. This article critically examines the 1992 decision by the Supreme Court of Canada on pornography (Butler v. the Queen). The decision, like the LEAF (Legal Education Action Fund), argues that the dehumanizing and degrading images of women in pornography undermine the achievement of gender equality and reinforce existing inequality. Section 15 of Canada's Charter of Rights and Freedoms takes precedence over Section 2(b) freedom of expression. More immediately, Section 163(8) of the Criminal Code of Canada remains the primary instrument for (...) dealing with pornography. These arguments fail to distinguish between degradation and devaluation; they offer no evidence of a connection between pornography and its effects on gender stratification, nor do they feel obliged to offer such evidence despite the extensive literature on inequality by the social science community. Citing the Sears-Roebuck case on gender discrimination, the author demonstrates that the enemy of gender equality is the stereotype of the idealized traditional woman, not the one-dimensional lust-driven nymphomaniac of pornography. Her opposite is not the "stud" of pornography who is in a constant state of tumescence but "economic man" who sublimates his sexual passion in sports, cars, politics, and money. Censorship, it is suggested, infantilizes women and contributes to their dependency. The article comments on the doctrine of "balancing" rights and on the meaning of "equality" within a feminist context. The larger questions of a trend toward the legalization of cultural issues and the role of the judiciary (weak in European democracies but strong in the American tradition) are raised. (shrink)

Este ensayo analiza diferentes aspectos de la evolución de la universidad en el mundo occidental. Se analiza esta evolución a través de algunos cambios normativos recientes de las universidades pertenecientes a este mundo y se tienen en cuenta los diferentes elementos que han influido en estos cambios. Entre estos cambios se enumeran aquellos que podrían permitir hablar de una refundación de la universidad, al menos en España, y se valoran las diferentes herramientas que permiten hablar del valor relativo de las (...) universidades y de su dependencia jerárquica. Finalmente, por medio de un ejemplo práctico, se cuestionan los modos mediante los que se establece cuál es el valor que se atribuye a cada universidad. This paper intends to analyse several different aspects of the recent evolution of Western Universities. This evolution is analysed through the examples offered by recent changes in the norms of some of these institutions, and the different elements that condition these changes are analysed as well. These changes could, to a certain extent, make it possible to speak about a refounding of universities, at least in Spain. The tools that are applied to the evaluation of universities are also taken into account, as are the relative value of universities and the hierarchical dependence among them. Lastly, and with the aid of a practical example, the methods by which universities are evaluated are questioned. (shrink)

Habermas' social philosophy can now be perceived in its oppositional structures and their symbolic meaning. His repetition of structural opposition finds its expression in the symbolism which pervades The Philosophic Discourse of Modernity in the opposition between the dreaded myth of the Dialectic of Enlightenment and the redemptive fantasy of the path yet to be taken. More significant for the intellectual culture of modernity is the neglect, by erasure on the part of this esteemed philosopher, of the great drama of (...) philosophy in our time. This is the drama occasioned by the dialectical struggle, rushing to climax in the 20th Century, between Enlightenment reason and its Counterenlightenment opponent. The struggle between these philosophical constellations is refracted in the great wars of this century. Thus the drama of the philosophical thought of the century and its historical development is lost. The philosophic discourse of modernity has yet to be written. Its text, once it has been freed from the tenacity of ideological hostilities and their erasures and concealing circumlocutions, will at the same time provide the sought-for foundation for social philosophy and a just society: it is the philosophic framework of Modernity itself which is the foundation of all modern philosophies, in the dialectic of Enlightenment and its Counterenlightenment other. El concepto de la vida en Nietzsche es una idea central, tanto de su propio pensamiento como en relación a sus repercusiones en el debate contemporáneo. Sus múltiples significaciones superan el campo en el cual inicialmente había sido planteado, invitando a la discusión en las fronteras disciplinares y al debate interdisciplinario. Se plantea examinar la concepción nietzscheana del eterno retorno desde la noción lacaniana de repetición con tal de esclarecer la idea de la vida como mujer.

El objetivo del presente artículo consiste en exponer el modo en el cual Lacan y Deleuze pueden contribuir a delinear una hipótesis sobre el estatuto de la afirmación. Pese a que tradicionalmente se ha tratado de mantener una separación estricta entre ambos pensamientos, mostraremos que existe la posibilidad de exponer una afirmación radicalizada, que pondría a ambos en la pista de un pluralismo abierto a las diferencias singulares no reducibles a una identidad dominante. En ambos casos, ello supondría una puesta (...) en entredicho y una reformulación de la negación. La lectura desarrollada por Lacan a partir del comentario hegeliano de la Verneinung, llevada a cabo por Jean Hyppolite, permite entender cómo la negatividad abre más bien cierto tipo de afirmación, que quizá anticipa la formulación de una ontología de la diferencia, como la que Deleuze advierte en Hyppolite contra Hegel. Intentaremos mostrar que dicha afirmación se produce conceptualmente al momento de elaborar cierta destitución del problema de la negatividad. En su mutuo refuerzo, advertiremos que se puede pensar una potencia de afirmación de la diferencia, apoyada en esta alianza entre una teoría elaborada desde preocupaciones clínicas y un pensamiento obstinado en sustraer a la diferencia de la negatividad. Our visual environment is highly predictable in terms of where and in which locations objects can be found. Based on visual experience, children extract rules about visual scene configurations, allowing them to generate scene knowledge. Similarly, children extract the linguistic rules from relatively predictable linguistic contexts. It has been proposed that the capacity of extracting rules from both domains might share some underlying cognitive mechanisms. In the present study, we investigated the link between language and scene knowledge development. To do (...) so, we assessed whether preschool children with Developmental Language Disorder, who present several difficulties in the linguistic domain, are equally attracted to object-scene inconsistencies in a visual free-viewing task in comparison with age-matched children with Typical Language Development. All children explored visual scenes containing semantic, syntactic, or both inconsistencies. Since scene knowledge interacts with image properties to guide gaze allocation during visual exploration from the early stages of development, we also included the objects’ saliency rank in the analysis. The results showed that children with DLD were less attracted to semantic and syntactic inconsistencies than children with TLD. In addition, saliency modulated syntactic effect only in the group of children with TLD. Our findings indicate that children with DLD do not activate scene knowledge to guide visual attention as efficiently as children with TLD, especially at the syntactic level, suggesting a link between scene knowledge and language development.
